The return of something lost or stolen so that the original situation is restored. This central theme of the OT law is supremely fulfilled through Jesus Christ making restitution for Adam’s sin, thus restoring fellowship with God and hope of eternal life.

Ex. 22:10-15
10 “If a man gives his neighbor a donkey, an ox, a sheep, or any animal to keep for him, and it dies or is hurt or is driven away while no one is looking,
11 an oath before the Lord shall be made by the two of them that he has not laid hands on his neighbor’s property; and its owner shall accept it, and he shall not make restitution.

Reasons for restitution

12 “But if it is actually stolen from him, he shall make restitution to its owner.
13 “If it is all torn to pieces, let him bring it as evidence; he shall not make restitution for what has been torn to pieces.
14 “If a man borrows anything from his neighbor, and it is injured or dies while its owner is not with it, he shall make full restitution.
15 “If its owner is with it, he shall not make restitution; if it is hired, it came for its hire.Reasons for restitution

For crimes committed

Exodus 22:2–3 ESV
If a thief is found breaking in and is struck so that he dies, there shall be no bloodguilt for him, but if the sun has risen on him, there shall be bloodguilt for him. He shall surely pay. If he has nothing, then he shall be sold for his theft.

Exodus 22:16–17 ESV
“If a man seduces a virgin who is not betrothed and lies with her, he shall give the bride-price for her and make her his wife. If her father utterly refuses to give her to him, he shall pay money equal to the bride-price for virgins.
Leviticus 6:1–6 ESV

Leviticus 24:17–21 ESV
“Whoever takes a human life shall surely be put to death. Whoever takes an animal’s life shall make it good, life for life. If anyone injures his neighbor, as he has done it shall be done to him, fracture for fracture, eye for eye, tooth for tooth; whatever injury he has given a person shall be given to him. “If a man causes a field or vineyard to be grazed over, or lets his beast loose and it feeds in another man’s field, he shall make restitution from the best in his own field and in his own vineyard. “If fire breaks out and catches in thorns so that the stacked grain or the standing grain or the field is consumed, he who started the fire shall make full restitution.

For unintentional sin

Leviticus 5:14–16 ESV
The Lord spoke to Moses, saying, “If anyone commits a breach of faith and sins unintentionally in any of the holy things of the Lord, he shall bring to the Lord as his compensation, a ram without blemish out of the flock, valued in silver shekels, according to the shekel of the sanctuary, for a guilt offering. He shall also make restitution for what he has done amiss in the holy thing and shall add a fifth to it and give it to the priest. And the priest shall make atonement for him with the ram of the guilt offering, and he shall be forgiven.

The basis of decisions regarding restitution

Arbitration

Exodus 22:8–9 ESV
If the thief is not found, the owner of the house shall come near to God to show whether or not he has put his hand to his neighbor’s property. For every breach of trust, whether it is for an ox, for a donkey, for a sheep, for a cloak, or for any kind of lost thing, of which one says, ‘This is it,’ the case of both parties shall come before God. The one whom God condemns shall pay double to his neighbor.

The amount of restitution is to exceed the amount stolen

Exodus 22:1 ESV
“If a man steals an ox or a sheep, and kills it or sells it, he shall repay five oxen for an ox, and four sheep for a sheep.

Land should belong to its rightful owners

2 Samuel 9:7 ESV
And David said to him, “Do not fear, for I will show you kindness for the sake of your father Jonathan, and I will restore to you all the land of Saul your father, and you shall eat at my table always.”

Examples of restitution

The Philistines make restitution for desecrating the ark of God; Ben-Hadad makes restitution for the cities his father had taken from Israel; The king makes restitution to the Shunammite by returning her house and land; Nehemiah orders restitution to be made to the poor; Zacchaeus makes restitution to those he had cheated.

The act of restitution is to be motivated by love

Romans 13:8–10 ESV
Owe no one anything, except to love each other, for the one who loves another has fulfilled the law. For the commandments, “You shall not commit adultery, You shall not murder, You shall not steal, You shall not covet,” and any other commandment, are summed up in this word: “You shall love your neighbor as yourself.” Love does no wrong to a neighbor; therefore love is the fulfilling of the law.

Jeremiah 30:17–18 ESV
For I will restore health to you, and your wounds I will heal, declares the Lord, because they have called you an outcast: ‘It is Zion, for whom no one cares!’ “Thus says the Lord: Behold, I will restore the fortunes of the tents of Jacob and have compassion on his dwellings; the city shall be rebuilt on its mound, and the palace shall stand where it used to be.

Jesus Christ makes restitution for sin

He restores fellowship with God

Romans 5:19 ESV
For as by the one man’s disobedience the many were made sinners, so by the one man’s obedience the many will be made righteous.

He restores the hope of eternal life

1 Corinthians 15:21–22 ESV
For as by a man came death, by a man has come also the resurrection of the dead. For as in Adam all die, so also in Christ shall all be made alive.

Restitution is made to Jesus Christ

Here God’s exaltation of Jesus Christ is seen as restitution to his position of glory.

And being found in human form, he humbled himself by becoming obedient to the point of death, even death on a cross. Therefore God has highly exalted him and bestowed on him the name that is above every name,
